Australian Immigration Law Alert – Constant Change to Protect and Manage Australia’s Borders

The establishment of the Home Portfolio, December 20, 2017, including the Department of Home Affairs (Department) and continues with the Department of Migration and Border Protection presents a new era for the protection and control of Australia's borders.

Regular change in law and policy

Changes of growth are reflected in major changes made in 2017, and will continue in 2018. This includes:

  • Provincial Tourism Scheme (section 187) (RSMS)
  • Proper Domain (Good Time) (section 489)
  • Skilled workers (section 190)
  • The Skilled Independent (section 189)
  • Training visa (section 407)
  • Completed work of Temporary Visa (sub-class 485) (only in certain cases).
  • Since 19 April 2017, the Government has continued to make major changes, which was very important on April 19, 2017 as section 1 in the list of skilled skills by:

  • A new Short-Term Working Fund (STSOL) aimed at meeting the minimum and medium-sized skills of the Australian business market;
  • Medium to Long-term Skills List (MLTSSL) aimed at meeting long distance skills requirements in the Australian labor market;
More than 219 jobs have been deleted from the list of job-support staff now and 59 jobs are subject to certain posts and additional blocks to prevent the use of visa programs for section 457 / subclass 186.
On July 1, 2017, section 2 of the 457 Visa Reforms included:

  • English-language quotation for applicants with $ 96,400 free of charge without transfer to other countries;
  • Introducing target reference requirements
  • Police certificates compulsory for all basic visa applications and primary grades at the age of 16.










On July 1, 2017, changes to ENS and RSMS include:

  • The need for an International English Testing System (IELTS) program (or equivalent test) of 6 parts per unit;
  • a maximum of 45 years during the application of applicants who have applied directly;
  • A maximum of 50 applicants for Temporary Residence Insurance Applicants.
  • In March 2018, the conversion of section 4 is intended to be used, including the completion of the 457 Visa Visa Transformation, which will have two streams, including:
  • Short-term broadcasting that will allow visa grant for two years, the requirement of IELTS or the equivalent of the estimated assessment rate
